1. Agreement
These Terms of Service ("Terms") govern your access to and use of VibeScan ("VibeScan," "we," "us") at vibescan.co and related services (collectively, the "Service"). By creating an account, running a scan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
VibeScan provides automated security analysis of software you submit (for example, static analysis of code and dependencies, and optional live application scanning). Output may include findings, explanations, and suggested remediation. The Service is a tool to assist you; it does not replace professional security review, penetration testing, or compliance obligations.
3. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@vibescan.co if you suspect unauthorized access.
4. Acceptable use
You agree that you will not, and will not permit others to:
- Use the Service to scan or probe systems, networks, URLs, or data that you do not own or for which you do not have explicit written authorization from the owner to perform security testing.
- Use live application scanning (DAST) only against URLs and deployments you control or are expressly authorized to test.
- Upload or submit malicious code, illegal content, or material you do not have the right to analyze.
- Interfere with or disrupt the Service, other users, or underlying infrastructure (including excessive automated access, denial-of-service attempts, or attempts to bypass rate limits or security controls).
- Misrepresent your identity or affiliation, or use the Service to violate applicable law.
We may suspend or terminate access if we reasonably believe you have violated this section or these Terms, or if required by law.
5. Fees and billing
Paid plans, pricing, and features are described on our website. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel through the billing tools we provide (including the Stripe Customer Portal where applicable). Fees are non-refundable except where required by law or as we expressly agree in writing.
6. Your content and our use of it
You retain ownership of your code and materials. You grant VibeScan a limited license to host, process, and analyze submissions solely to provide the Service and as described in our Privacy Policy. We do not claim ownership of your source code.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SECURITY SCANNING MAY PRODUCE FALSE POSITIVES OR FALSE NEGATIVES; RESULTS ARE NOT A GUARANTEE THAT YOUR SOFTWARE IS SECURE OR FREE OF VULNERABILITIES.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESCAN AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
9. Indemnity
You will defend and indemnify VibeScan and its affiliates, officers, and agents against any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your submissions, or your violation of these Terms or applicable law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate the Service or your access with reasonable notice where practicable, or immediately if we believe you have materially breached these Terms or acceptable use, or if necessary to protect the Service or other users. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
11. Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. If changes are material, we will provide reasonable notice (for example, by email or in-product notice). Continued use after the effective date constitutes acceptance of the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Washington, without regard to conflict-of-law rules. You and VibeScan consent to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington, for any dispute arising out of these Terms or the Service, subject to applicable law.
